MADISON —The state has settled a lawsuit against Aurora Health Care, Inc. of Milwaukee for violations of state air pollution control laws at facilities Aurora constructed and operates in Brown, Manitowoc, Winnebago, Washington and Kenosha Counties.
According to the complaint, filed at the request of the Department of Natural Resources, Aurora failed to obtain air pollutant source construction and/or operation permits for a number of its facilities, and violated emission limits and other air pollution control requirements at some of the facilities, including:
the requirement that air pollutant sources be constructed in accordance with the application and permit;
the requirement that Aurora conduct stack tests of the emissions from generators at the facilities;
the requirement that reports and test results be submitted to DNR in a timely fashion;
requirements related to assuring the maintenance and use of low-sulfur fuel supplies.
Under the terms of the settlement agreement, Aurora will pay penalties, fees, and costs totaling $250,000 for the violations.
“We will continue to work with the DNR to make sure that Wisconsin’s environmental laws are followed,” said Wisconsin Attorney General J.B. Van Hollen.
Assistant Attorney General Shari Eggleson prosecuted the case. The settlement was approved by Dane County Circuit Court Judge Shelley Gaylord.
