Quarles & Brady LLP: Victorious in three significant Wisconsin Supreme Court cases

MILWAUKEE, Wis. – Quarles & Brady LLP today announced that the Firm achieved three significant Wisconsin Supreme Court victories in the past two weeks.

The cases include the finding of an easement violation by a private club and subsequent trespassing. That case was successfully argued by lead attorney John Rothstein, a partner for the Firms’ Litigation and Dispute Resolution practice in the Milwaukee office. There are tens of thousands of such easements across the State that will be governed by the decision.

The second victory for the Firm was in its Commercial Bankruptcy, Restructuring and Creditors’ Rights practice area, and the lead attorney was Madison-office Partner Valerie Bailey-Rihn. That case held that a beneficiary of a letter of credit can draw on the letter of credit without fear that the proceeds can be seized by a receiver if the company on whose behalf the letter of credit was given files for receivership. For example, a vendor may ship goods to a customer who puts up a standby letter of credit for payment without being concerned that if the customer does not pay and files for receivership, the vendor will be forced to repay the money to the receiver.

The third case also was a Creditors’ Rights matter. The Supreme Court ruled that in a foreclosure action, lenders may waive rights to a deficiency judgment against borrowers to obtain a shorter redemption period, without jeopardizing their claims against guarantors. The lead attorney on that case was Roy Prange, a partner in the Firm’s Madison, Wis. office.
